Chairman Gordon Wemp called the meeting to order at 7:00 pm.
Members present Gordon Wemp, Michelle Warman, Michael Castiglione and Jude
Sillato. Joseph Belluck was absent.
1. ADMINISTRATIVE MATTERS
MINUTES APPROVAL- Move to accept March 11, 2021 meeting
minutes by Gordon Wemp seconded by Michelle Warman. All voted aye.
Motion adopted.
CHANGES/ADDITIONS TO
MEETING AGENDA – No changes were made.
2. PUBLIC HEARINGS
SCHEDULED FOR March 25th, 2021
None at this time.
3. DECISION AND ORDERS AND
INTERPRETATIONS OUTSTANDING
ZBA CASE # 21-03. Michelle
Leggett and Stephen Bergkamp. Chairman
Wemp made a motion to re-open this case, seconded by Michael Castiglione. There were
no further comments from the board. Chairman Wemp closed the case, seconded by
Michael Castiglione, all voted aye. Chairman Wemp read the following
resolution.
RESOLUTION: Based upon the Standards for Consideration of Area
Variances and conditional upon compliance with stated representations, Area
Variances from the Zoning Law of the Town of Woodstock, Article V,
Supplementary Regulations, Section 260-32 (A) (C) Fences, Walls and Gates, to
legalize the replacement of a 4 foot high picket fence with a 6 foot high
stockade fence in the front yard on a corner lot with two front yards, is
hereby GRANTED WITH CONDITIONS subject
to all requirements of the Zoning Law of the Town of Woodstock, the New York
State Real Property Law and all other applicable laws, codes and
regulations.
CONDITIONS:
1.
The
fence may remain at six (6’) feet high along the subdivision boundary where the
new road has been created.
2.
Any
existing or further construction of fencing, along Van Dale Rd, shall be constructed,
reduced and/or adapted to a four (4’) foot height fence.
The vote was announced

THE RESOLUTION WAS (ADOPTED) by a vote of ( 4 ) in favor, ( 0 ) opposed, ( 1 ) absent, and ( 0 ) abstaining.

ZBA CASE #21-04. Application of Byron Duckwall.
Chairman Wemp mate a motion to re-open the case seconded by Michael
Castiglione. Jude Sillato is concerned about the actual structure being placed
on such a small lot, but it is proposed to be on the side yard but it could be
placed in the back yard. An email received from Kingston Water Works
(see attached). Michael Castiglione stated he would do a drive by this
week. Gordon Wemp stated he doesn’t
think it will be too much square footage building coverage for the property. Chairman
Wemp recessed ZBA Case # 21-04 second by Jude Sillato, all voted aye.

ZBA Case # 21-05
Ralph Goneau.. Chairman Wemp made a motion to re-open the case, seconded by
Jude Sillato This is Joe Belluck’s case. Chairman Wemp doesn’t see granting it
without creating a lot of trouble down the road. Both lots would be undersized.
It is allowed to have a large size lot and then subdivide it into an undersized
lot and a regular sized lot. What is not permitted because there is a formula,
is creating two undersized lots. There
were no comments from the board members. Chairman Wemp made a motion to recess
the case, seconded by Jude Sillato, all voted aye.

ZBA Case #21-06 Application of Andrew Peck and Chloe Dresser.
Chairman Wemp made a motion to re-open the case, seconded by Michael
Castiglione and Michelle Warman. This is Jude Sillato’s case and she stated she
is waiting to hear from the UCPB. The board received some new information via
email from Mr. Peck. Chairman Wemp made a motion to recess the case, seconded
by Jude Sillato, all voted aye

ZBA CASE # 21-01. Terry
Dagrosa. Chairman Wemp made a motion to re open this case, seconded by Michelle
Warman and Jude Sillato, all voted aye. Michelle Warman asked why she was
looking to have this space as an STR and not rent it out as a room on a
permanent basis as a long term rental for extra income? Chairman Wemp answered
by saying she could but Jude Sillato stated there was no kitchen, it is just a
bedroom and a bathroom. She could still rent it out and have like a roommate.
Chairman Wemp stated with an STR she could rent the room out for the weekend
without the need to provide eating facilities. Jude Sillato mentioned there
used to be places in town that rented rooms out without kitchens. Chairman Wemp
said he would write up a draft decision for the next meeting. There were no
comments from the board members. Chairman Wemp made a motion to recess the
case, seconded by Jude Sillato, all voted aye.
4. OTHER
Chairman Wemp mentioned there was a new case ZBA # 21-07
Nancy Adler/ 105-109 Mill Hill Road LLC and he would be in charge of it.
Discussion of the application took place amongst the members regarding take out
food in the Town.
Chairman Wemp made a motion to adjourn the ZBA meeting,
second by Jude Sillato and Michael Castiglione. All voted aye.
