and Order ZBA Case # 19-11
Chairwoman
Mendoza called the meeting to order at 9:30 am. Members present, Michael Castiglione,
Gordon Wemp, Jeff Collins, Maria Mendoza and James Armstrong. Jude Sillato was
absent.
DECISION
AND ORDERS AND INTERPRETATIONS OUTSTANDING
ZBA CASE #19-11 Application of Benjamin Atkins, represented by Joe
Greco. Chairwoman Mendoza reopened the case,
seconded by Michael Castiglione. There were no further comments or questions
from the board. Chairwoman Mendoza made a motion to close the case, seconded by
Gordon Wemp and James Armstrong. All votes aye. The following resolution was
read by Chairwoman Mendoza.
RESOLUTION:
Based
upon the Standards for Consideration of Area Variances set forth in Section
260-103B of the Zoning Law of the Town of Woodstock, area variances from the
Zoning Law of the Town of Woodstock, Article IV, Area & Bulk Regulations,
Modification of required yards, Section 260-26 B (1) (b) for a 2.5 foot
infringement into a minimum required 15 foot side yard setback in order to extend
the existing entrance with an ADA ramp; Section 260-26 (B) (1) (c) for a 22.5
foot infringement into a minimum required 25 foot side yard setback in order to
remove an existing shed and replace it with a 10 foot by 16 foot wooden deck
and pergola; and for a 20.5 foot infringement into a minimum required 25 foot
side yard setback in order to construct a new stone patio and portico, are
hereby GRANTED, subject to all requirements of the Zoning Law of the Town of
Woodstock, the New York State Real Property Law and all other applicable laws,
codes and regulations.
The
vote was announced as follows: Maria
Mendoza: (aye ),Michael Castiglione (aye ), Gordon Wemp: (aye ), James
Armstrong: ( aye), Jude Sillato: (absent ), Jeff Collins: ( no vote).
THE RESOLUTION WAS (ADOPTED) by a vote of ( 4 ) in favor, ( 0 ) opposed, (1
) absent, and ( 0 ) abstaining.
Chairwoman
Mendoza read the following statement: ** “ It was brought to my attention that
at the June 13th meeting I mentioned the Lodge case and Auringer
case would be recessed until the second Thursday in July. I am amending those
minutes and date by stating I meant to say the second meeting in June. Thank
you.”
Chairwoman
Mendoza mentioned there is a new case that came of Mike and Robin Kramer and it
was assigned to James Armstrong. It is for a pool and a pool fence.
Chairwoman
Mendoza reminded Michael Castiglione to contact Ellen regarding ZBA Case #
19-08 of Immacolata Mazzone so they can vote on it at next Thursday’s meeting.
Gordon
Wemp asked if Chairwoman Mendoza had received any new communications or
information on the draft interpretation on The Lodge? Chairwoman Mendoza and
Michael Castiglione mentioned she had sent an email with the new wording
yesterday. Rod Futerfas redrafted the document for the board embers to review.
Chairwoman
Mendoza mentioned Rod Futerfas hadn’t sent a redraft of the Auringer case yet.
Once he does she will sent it to all the members.
Chairwoman
Mendoza made a motion to adjourn the meeting, seconded by James Armstrong. All
voted aye.
