APPROVED PLANNING BOARD MINUTES

August 4, 2011

Members Present:  Paul Henderson (arrived 6:45); Peter Cross; Allan Duane; James Huben; Lorin Rose and Tom Unrath

Member Absent: Chairman Paul Shultis, Jr.

Others Present: Therese Fernandez, Secretary

Meeting called to order by Acting Chairman James Huben at 6:30 pm. Determination of a quorum.

      Agenda:  No changes.     

      Minutes:  Minutes of June 2, 2011 will be considered for approval at next meeting.  

Pending Items:

Holy Ascension Monastery, Coldbrook Road, in Wittenberg: proposal for pre-sketch conference; assign PB case reps; schedule sketch meeting with Planner and applicant?

Allan Duane volunteered to be a case representative. Paul Henderson will be the other PB rep.  (Mr. Henderson arrived at this point)  The sketch meeting will be discussed with Mr. Shultis.

 Review Woodstock Farm Animal Sanctuary (WFAS) Environmental Assessment Form (EAF) for SEQR Determination amendment

Ms. Fernandez noted that this has been classified as a Type II action all along.  Regarding the most recent Special Use Permit (SUP) modification, and in the Completeness Review done by former Planning Specialist Trahan, a determination of significance was not needed for the overall project.  Planning Board attorney Ms. Grant was not aware of this so she left a message for Ms. Fernandez saying she might not agree with Ms. Trahan's assessment.  At first, Ms. Grant said we do need to amend the EAF; later, she called back and said she felt that everything might be okay as is. This is on hold pending Drayton Grant's e-mail with further instructions on this case.

Rueda SUP Draft Resolution and Permit for approval; site visit done?; waive Public Hearing?; sign final plats and permit?

Mr. Duane had done a site visit this morning.  He said it is not visible from houses in the area, although it is visible from the road.  He saw no signs of drainage problems or land disturbance.

Mr. Rose said he had gone by and concurred with Mr. Duane's assessment. Both did not think a Public Hearing is necessary.

Mr. Rose made a Motion to waive the Public Hearing, seconded by Mr. Duane. Vote: 6-0-1-0.

Acting Chairman Huben went over the wording of the draft Resolution. He then made a Motion to pass the Resolution, seconded by Mr. Henderson. Vote: 6-0-1-0. Special Use Permit will be signed by Chairman Shultis.

KAROLYS, ROD, SPR #11-341, SUP #11-421: Preliminary review of proposed multi-family senior housing development to be constructed at the corner of John Joy and Purdy Hollow Roads in Zena, SBL# 27.4-2-34.100; Rep: Scott Lane, PE; PB Reps: Mr. Huben & Mr. Unrath   

Mr. Karolys was concerned about the necessity of a Commission for Civic Design (CCD) review. Discussion and review of zoning law, powers of CCD. Mr. Huben said PB Reps will try to make the CCD review process easier; he will talk Mr. Shultis about it. 

Mr. Cross mentioned that any impact to wetland buffer could be mitigated by setting aside a portion of land.

Mr. Huben inquired about lighting and stormwater. Mr. Karolys stated that he's not ready with those details; his engineer couldn't come tonight.

Mr. Henderson asked what did Planners recommend? Mr. Karolys answered that it was "boilerplate"; need curb cut and Board of Health approval; Ulster County Planning Board referral not necessary.

Applicant Assistance List provided, to include everything on AAL dated 6/16/11, except CCD referral, which was done:

•·         stormwater treatment and drainage plans

•·         grading & lighting plan

•·         updated plans for Planning Board and Planner

Case to return on September 1st.

LANG, MICHAEL, PB #11-1123A: Third sketch review, subdivision of 91.30 acres parcel into three (3) lots: 20.32 acres, 54.45 acres and 16.67 acres, located between Wittenberg-Mt. Tremper and Coldbrook Roads, in Wittenberg, SBL 36.2-1-30.100; Rep: Robert G. Cross, PLS; PB Reps: Mr. Cross & Mr. Unrath

Robert Cross and Mr. Lang were present and explained application so far. Copy of Ulster County curb cut permit and new maps were submitted. Board of Health approval is "in the works".  Robert Cross felt it was "overkill situation" with the driveway off Coldbrook Road; trying to avoid necessity of guard rails and driveway switchbacks in scenic field.

It is 15% grade at the deepest part; fill can be blended in. Mr. Huben polled the Board to see if they were OK with it. All members agreed that application looks ready for Public Hearing.

Mr. Huben made a Motion to approve the 15% driveway for reasons previously stated, seconded by Mr. Henderson. Vote: 6-0-1-0.

The following items from Applicant Assistance List dated 7/7/11 are still pending:

   *   Health Dept. septic approval

   *   add note that if Lot #2 is subdivided in the future, all wetlands must be delineated

Mr. Huben made a Motion to set the Public Hearing for September 1st, conditional upon Health Dept. approval, seconded by Mr. Duane. Vote 6-0-1-0.

ROSENSTEIN, WARREN, WWP #11-016: Sketch review of Wetlands & Watercourse Permit application to construct 324 sq. ft. of decking within required buffer of the Little Beaverkill stream in Wittenberg, SBL# 26.3-1-35; Rep: John Wasylyk, PE; PB Reps: Mr. Rose & Mr. Huben

Chuck Holtz was applicant's representative present in place of John Wasylyk. He explained work to be done which included nine 8-inch diameter hand-dug deck piers. Discussion about deck pilings vs. piers, and buffer area. Peter Cross referred to the Wetlands & Watercourse Law; is it a disturbance of the stream bank? NYC Dept. of Environmental Protection (NYCDEP) says proposed deck is ancillary to house. Mr. Cross said opinion of NYS Dept. of Environmental Conservation (NYSDEC) is still needed. Some discussion followed concerning the definition of a structure. Mr. Cross asked if deck can be located elsewhere on the site or avoided altogether; owner explained the hazards he's removed or improved during the course of renovation work.

Case will be rescheduled once NYSDEC response is received.

MARTIN, JUDITH, WWP #11-017: Postponed until August 18, 2011. Mr. Unrath said he went to the site but will be absent from meeting on 8/18/11 when case is rescheduled.  He feels the application should be approved pending environmental assessment. Peter Cross said that engineer is coming to review the proposed work along stream bank for NYSDEC.
