BE IT RESOLVED, to accept the resignation of Andrew Doyle from the Town of Woodstock Highway Department, effective July 1st, 2019.
WHEREAS, Gourmet Enterprises, LLC, AKA – Catskill Mountain Pizza, LLC, 51 Mill Hill Rd., Woodstock, NY 12498, is in compliance with the Alcoholic Beverage Control Law Section 64 Subdivision 2A, has notified this municipality of their intent to file application for a liquor license with the New York State Liquor Authority, and
WHEREAS, this property is currently in compliance with all Local Laws and does not have any violations at this time,
THEREFORE BE IT RESOLVED to waive, in this instance, the thirty (30) day period to review said application and consent to the issuing of a liquor license to the above named applicant.
BE IT RESOLVED, to authorize the Town Clerk to publish in the Town’s official newspaper the following notice:
The Town of Woodstock Highway Department is scheduled to start milling the following roads on July 22nd and 23rd (weather permitting).
- Reynolds Lane including the intersections of MacDaniel Rd and intersection of Church Rd
- Lark Drive
- Forest Drive
- Manor Drive
- Elwyn Drive
WHEREAS, the Town of Woodstock Town Board is considering the adoption of a Local Law, pursuant to New York State Constitution, Article IX, Municipal Home Rule Law 510, amending the Official Zoning Map of the Town of Woodstock (hereinafter referred to as the "proposed action"); and
WHEREAS, the attached Local Law amends the Official Zoning Map (see also attached Zoning District Boundary Change Map, dated March 24, 2019) for the following lots as follows.
Lot 27.18-5-3 — in its entirety to Ll District;
Lot 27.18-5-4 — in its entirety to Ll District;
Lot 27.18-5-5 —in its entirety to Ll District;
Lot 27.18-5-6 — the portion of the lot currently zoned R3 District containing part of the pond and fronting on Hasbrouck Lane abutting the Ll District zoned portion of the property will be rezoned to Ll District. The rectangular portion of the existing lot extending southerly into the existing R3 District will remain zoned R3 District as currently shown on the existing Official Zoning Map; and
WHEREAS, the proposed action, which involves the rezoning of less than 25 acres of land within the Town of Woodstock, is thus classified as an Unlisted action pursuant to SEQR 6 NYCRR Part 617; and
WHEREAS, the proposed action consists of a direct legislative action by the Town Board, the sole agency in regard to the funding, approval and undertaking of the proposed action. As a direct legislative action, the proposed action does not involve any construction, land alteration or other physical land development activities affecting the real property involved. Therefore, in accordance with the standards and definitions as set forth in SEQR 6 NYCRR Part 617, the Town Board is the only "involved agency" and thus the "lead agency" for the environmental review of the proposed Unlisted Action (as there are no other SEQR involved agencies to coordinate with); and
WHEREAS, the proposed action is being considered at such time as there is no review of any pending land use applications which may or may not be filed in the future affecting the real property involved, is corrective in nature related as much to existing uses as to possible future uses, and would be no less protective of the environment because any future use would be required to undergo a full land use and environmental review at the time such applications might be filed, therefore the current environmental review of the proposed action is not segmentation; and
WHEREAS, a Short Environmental Assessment Form has been prepared in support of the proposed action and has been considered by the Town Board; and
WHEREAS, the Woodstock Planning Board has issued a Report and Recommendation to the Town Board dated December 20, 2018 recommending adoption of the proposed action, thereby satisfying related referral requirements as set forth in Section 260-114 of the Woodstock Zoning Law considering: (1) if the proposed action is consistent with the purposes of Town Zoning; (2) what areas or establishments might be affected; (3) the adequacy of public services; (4) any indirect impact on other regulations; and (5) whether the proposed action is consistent with the Town Comprehensive Plan; and
WHEREAS, the proposed action was duly referred by the Town Board to the Ulster County Planning
Board in accordance with Section 260-115 of the Woodstock Zoning Law as well as Section 239-LMN of General Municipal Law, to which County Planning responded on July 9th, 2019 indicating the affirmative and
WHEREAS, the proposed action was not required to be referred by the Town Board to any abutting
Towns surrounding Woodstock in accordance with Section 260-115 of the Woodstock Zoning Law; and
WHEREAS, the Town Board held a duly noticed Public Hearing, on May 14th, 2019, at which time interested parties were heard;
NOW THEREFORE BE IT RESOLVED, that the Woodstock Town Board close the public hearing on this matter: and
BE IT FURTHER RESOLVED, that the Town Board, pursuant to the provisions of SEQR 6 NYCRR Part 617, hereby determines that it is the sole involved agency with jurisdiction over the proposed action, and further hereby confirms its status as lead agency for the environmental review of this Unlisted (legislative) action; and
BE IT FURTHER RESOLVED, that the Town Board, as lead agency and the sole involved agency, pursuant to SEQR 6 NYCRR Part 617, has considered the Short Form EAF with corresponding material contained in the aforementioned Planning Board Report and narrative prepared in regard to the proposed action, as well as the comments and recommendations of the Ulster County Planning Board, and the public; and
BE IT FURTHER RESOLVED, that the Town Board, as lead agency, hereby determines that the proposed Unlisted (legislative) action will not have a significant adverse effect on the environment, pursuant to SEQR 6 NYCRR Part 617, as detailed in the attached Negative Declaration attached hereto and made a part hereof, thus determining that preparation of an Environmental Impact Statement is not required; and
BE IT FURTHER RESOLVED, that the Town Board, as lead agency, hereby issues the attached Negative Declaration, which includes supporting reasons for its determination of SEQR Non-Significance (Negative Declaration); and
BE IT FURTHER RESOLVED, that the Town Board hereby adopts attached Local Law #2 of 2019; and
BE IT FURTHER RESOLVED, that the Town directs the Town Clerk to circulate and file the attached Negative Declaration and Local Law, as issued and adopted herein, in accordance with the requirements of SEQR 6 NYCRR Part 617 and the Woodstock Zoning Law; and
BE IT FURTHER RESOLVED, that the attached adopted Local Law shall take effect immediately upon filing with the New York Secretary of State, pursuant to New York Municipal Home Rule Law 527.
